  • This website is created, owned, developed, administered and maintained by Wine Australia.
  • These terms and conditions (Terms and Conditions) constitute a legal agreement between you (‘yoursquo;) and Wine Australia (ABN  89 636 749 924) (‘we’, ‘us’) governing the use of websites or mobile applications controlled by Wine Australia which link to these Terms and Conditions (‘Sites’).
  • These Terms and Conditions do not apply to any third-party websites or mobile applications that do not link to these Terms and Conditions.
  • By using any of our websites you agree to these Terms and Conditions.
  • We may revise the Terms and Conditions from time to time and revised terms will take effect when they are posted.
  • If some Sites or parts of our Sites are governed by additional terms and conditions, we will notify you, and those additional terms and conditions will prevail over these Terms and Conditions to the extent of any inconsistency.

1. Privacy

  • Wine Australia takes all reasonable steps to protect the personal information we hold against loss, misuse, interference and from unauthorised access, alteration or disclosure. We also take all reasonable steps to ensure we comply with all applicable legislation and our own privacy policy (Privacy Policy). A copy of Wine Australia’s Privacy Policy can be found here.

2. Intellectual Property Rights

  • Unless otherwise stated Wine Australia owns all the copyright and/or other intellectual property rights subsisting in the Sites, and the material on the Sites is owned or licensed by us and protected by the laws of Australia.
  • You are authorised to view the Sites and their content. You must not otherwise sell, reproduce, publish, distribute, communicate to the public (e.g. by making available online or electronically transmitting) modify, display, perform in public, prepare derivative works based on or make an adaptation of, repost or otherwise use any of the Site content in any way, except as permitted by law or with our prior written consent.

3. Disclaimers - Content on the Sites

  • While the information provided on our Sites has been prepared with reasonable care and skill, to the maximum extent permitted by law, we do not warrant that the content is accurate, current, suitable or complete. Your use of the Sites is at your own risk.
  • All prices quoted on the Sites are in Australian dollars unless otherwise indicated.
  • We may delete, change or move content on the Sites at any time without prior notice.
  • You acknowledge that Wine Australia shall have the right, but no obligation to pre-screen, refuse or remove any content.

4. Your Use

  • You agree to abide by all applicable laws relating to your use of the Sites, and agree not to disrupt, modify, interfere or otherwise perform any action with the intent of damaging the Sites, servers or other software, hardware or equipment connected to the Sites.

5. Indemnity

  • You agree to indemnify and hold Wine Australia harmless from any claim ,action, damage, loss, liability, cost, charge, expense, outgoing or payment suffered, paid or incurred by us  against us arising out of the use of Your Content including where you submit, post or otherwise make available Your Content through the Sites, your use of the Sites, or your breach of these Terms and Conditions.

6. Registration

  • In some instances you may be required to become a registered user to access parts of our Sites. Registration is free but non-transferable. You agree to provide true, and accurate information about yourself. Registration information and personal information you provide is subject to our Privacy Policy.
  • We reserve the right to refuse requests to register user accounts or to terminate your registration at any time at our sole discretion.
  • You are responsible for maintaining the strict confidentiality of your account login name and password, and you are responsible for any activity under your account and password. It is your sole responsibility to control the dissemination and use of your password, control access to and use of your account and notify us when you desire to cancel your account.
  • You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security.

7. General Provision

  • If any part of the Terms and Conditions is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect.
  • The Terms and Conditions are governed by the laws of the State of South Australia, Australia and you agree to submit to the non-exclusive jurisdiction of the courts of South Australia.

8. Social Media

  • Wine Australia does not accept responsibility for the comments of fans on its social media pages and it’s important to note that postings to the Wine Australia Facebook page are not representative of the opinions of Wine Australia or the Government of Australia, nor do we confirm their accuracy.
  • We encourage the expression of opinions and free, frank and open discussion. However, posts will be deleted if we determine that they contain:
    • offensive, inaccurate, false, misleading or deceptive, violent, obscene, profane, hateful, derogatory, illegal or racist comments, content, links or images or incite such comment or behaviour;
    • comments that threaten or defame any person or organisation;
    • solicitations, advertisements, or endorsements of any financial, commercial organisations;
    • multiple successive off-topic posts by a single user;
    • repetitive posts copied and pasted or duplicated by single or multiple users;
    • material which infringes third party intellectual property rights; and
    • any other inappropriate content or comments as determined by Wine Australia
  • Users who do not comply with this policy may be blocked from the page in Wine Australia's absolute discretion.

9. Contributing to Wine Australia's Social Media Profiles

  • Wine Australia does not claim any ownership rights in photos or videos (Social Media Content). However, by submitting your Social Media Content you hereby grant to Wine Australia a non-exclusive, royalty-free, worldwide, revocable, non-transferable, perpetual licence to use, modify, delete from, add to, publicly display and/or reproduce your Social Media Content, including editing, compiling and assembling video works, interstitials or the use of photographic works as underlying works compiled into moving image without limitation in any online media formats (including e-newsletters) and through any social media channels, pages or accounts.
  • If your Social Media Content is used on Wine Australia’s digital or social platforms (including Facebook, Instagram, LinkedIn, Weibo and Twitter), your name and/or business will be credited using the appropriate handle or hashtag.
